This document provides answers to frequently asked questions on the McKinney-Vento Homeless Assistance Act and the education rights of children and youth in homeless situations.  It is meant to provide basic information and tools to assist parents, youth, educators and advocates in understanding the McKinney-Vento Act.The answers are general responses based on the law. It cannot be emphasized enough that these are general responses, and that answers could change based on the facts of a particular case.  McKinney-Vento issues require a case-specific inquiry.

Determining Homelessness by the Definition (NLCHP, 2003)

Experience has shown that, despite its specificity, the  McKinney-Vento Act's definition of homelessness leaves us with some gray  areas.  This flow chart is designed to assist parents, youth, advocates  and educators to determine whether a particular child or youth is eligible for  McKinney-Vento Act services.  It guides the user through the Act's  definition of "homeless child and youth", including definitions and tips for  applying the definition to specific living situations.

McKinney-Vento Flowchart (NLCHP, 2002)

This flow chart is designed to assist parents, youth, advocates and  educators to determine how the McKinney-Vento Act applies to a particular  case.  By answering each successive question "yes" or "no", the user is  guided through the flow chart process to learn what McKinney-Vento rights and  services apply, including such rights as immediate enrollment in school  without documents, attendance at the school of origin, transportation, and  supplemental services.  Each question includes Hints to help reach the  correct answer and move on through the chart.

Immunization Policies by State (NLCHP, December 2003)

Since the McKinney-Vento Act requires that  schools enroll homeless children and youth immediately, they are not subject  to conflicting state immunization requirements.  However, experience has  shown that conflicting state requirements can result in enrollment delays for  homeless students. This chart describes the policies from 30 states regarding  immunization requirements for school enrollment.  It includes any  specific exceptions for students experiencing  homelessness.
